The Islamic Marriage
Marriage is legal union between a man and a women. Nikkah
is an Arabic term which means contract ,therefore marriage is seen as a
contract. Marriage in Islam is seen as a vital part of Muslims life as its so
important in Islam that it is declared to be a half of a Muslim faith.
There are many purposes of marriage such as fulfilling
Allah's command. To secure a comfortable atmosphere for both husband and the
wife, to procreate through marriage, a new generation of healthy faithful and
virtuous children are born since the family is a school of moral.
To ensure financial competence in the community. To promote interfamily alliance. Also to safeguard the legitimacy of children
who if gotten through marriage are entitled to inheritance. And improving the couples social status
through earning respect and dignity in the society
Marriage has it’ conditions and regulations which
includes: “Al sight,” The formula which includes the offer and acceptance. The other may be presented directly or
through an agent which then gives room for the acceptance in this case, the
process begins with the man’s proposal which presents his full identification
and intent on the other hand.
“Al Aqidun,” the contracting parties it refers to the
bride and the groom who must satisfy conditions
of marriage such as: Be of sound mind, have attained maturity, must give their
consent and they should not belong to the prohibited degrees of marriage.
“Ash-Shuhud” witness ,it has been given great
importance in Islam and therefore the marriage should be contracted before two
male Muslim witnesses who must be mature and sane . They must understand the
language in which the marriage ceremony is being conducted.
“Al Wilayat” Guardianship , the guardian is in charge
of giving consent or permission for the marriage to proceed . The shariah (law)
gives the father the first position as the guardian. In the case that the father is absent,
then Guardianship will take the
following order : the grandfather, full
brother and the father’s brother.
Al- Mahr (Dowry),is an obligatory gift given to the
women in marriage. It can either include a service or other material things
like money, property or any other assets. This can either be paid fully or
partially on the day of nikkah. The Women
is given the right to request for whatever dowry she wants . This should be
done on measurable terms without over burdening the groom . In the event where the
woman asks for divorce she is obliged to return the dowry.
